These Terms of Service ("Terms") govern your access to and use of the Letshape application and its related services (collectively, the "Service"), operated by Letshape ("we", "us", "our"). The Service allows you to create and manage project ideas, add activity notes, write rich-text document notes, and create Excalidraw drawings. You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to:
To use certain features of the Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date. You must notify us immediately of any unauthorized use of your account.
You retain all rights to the content you create and submit to the Service ("Your Content"), including your project ideas, notes, and drawings. You grant us a non-exclusive, worldwide, royalty-free license to host, store, and process Your Content solely to provide and operate the Service for you. You represent and warrant that you own Your Content or have the necessary rights to use and submit it.
The Service, including its software, design, text, graphics, logos, and other materials, is the property of Letshape or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.
The Service may integrate with third-party services, including Google Sign-In for authentication. Your use of any third-party service is subject to that third party's own terms and privacy policy, and we are not responsible for the actions or policies of such third parties.
We may suspend or terminate your access to the Service, in whole or in part, at any time, with or without notice, if we believe you have violated these Terms or for any other reason. Upon termination, your right to use the Service will immediately cease. You may also stop using the Service and delete your account at any time.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LETSHAPE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US, IF ANY, FOR ACCESS TO THE SERVICE.
We may revise these Terms from time to time. The most current version will always be posted on this page. If a revision, in our sole discretion, is material, we will notify you via email or a prominent notice within the Service. By continuing to access or use the Service after revisions become effective, you agree to be bound by the revised Terms.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Letshape is established, without regard to its conflict of law provisions. Any legal suit, action, or proceeding arising out of these Terms shall be instituted in the competent courts of that jurisdiction.
